Terms and Conditions

1. Object of the Agreement and Applicable Regulations

The company Gemelli Immobiliare S.R.L.S. (Lessor) leases to the Renter (Lessee) the Recreational Watercraft specified in the booking. This agreement is governed by Articles 42 to 46 of Legislative Decree No. 171 of 18/07/2005 (Italian Recreational Navigation Code). The Renter shall operate the vessel and assumes all associated responsibilities and risks. The original agreement or a certified true copy must be kept on board.

2. Bookings, Price, and Payment

• Online Bookings: Payment of a deposit via PayPal or Stripe obligates the Lessor to hold the vessel available for the agreed period.

• Price: Includes VAT (sales tax) and stamp duty, if applicable. The balance is to be paid upon delivery/collection.

• Overtime Rates: Any price differences due to exceeding the booking duration will be settled upon return of the vessel.

• Supplementary Assistance: By paying an additional fee of €10.00 upon signing the agreement prior to departure, the Renter waives the technical intervention fees outlined in Section 6.

3. Cancellations, Refunds, and Delays

• Cancellation more than 6 days prior to the booking: The Renter is entitled to a full refund of the deposit paid.

• Cancellation within 6 days or No-Show: The Lessor shall retain the full amount of the deposit paid (€100.00) as compensation.

• Bad Weather: If weather or sea conditions prevent a safe start to the rental, the Renter is entitled to a full refund of the deposit or a rescheduled booking on an alternative date. In the event of a forced early return due to sudden, severe bad weather, a 50% refund for the unused rental period will be issued.

• Delays: In case of notification within 30 minutes, the vessel remains available until the scheduled end of the rental with no change in price. For delays in returning the vessel not exceeding 1/10 of the total duration of the agreement, a fee equal to double the established rate shall be due.

4. Obligations of the Lessor and Renter

• Lessor: Agrees to deliver the vessel in perfect working order, equipped with all mandatory safety gear, documentation, and insurance in compliance with the law.

• Renter: Must use the vessel in accordance with the technical specifications of the navigation license and strictly for recreational purposes. The Renter is responsible for its proper use, may not entrust it to third parties, and must respect the maximum capacity of passengers allowed on board.

• Safety: The Renter agrees to comply with all navigation, safety, and health regulations, assuming full civil and criminal liability.

5. Damage Management and Penalties (Minimum Reimbursement Table)

Any damages will be reimbursed via credit card charge or withheld from the security deposit. If the damage exceeds the deposit amount, the Renter shall pay the difference upon returning the vessel.

6. Technical Assistance

Technical assistance fees requiring a support boat are €80 within the La Maddalena Archipelago and up to €130 outside the Archipelago. These fees are entirely waived if the "Supplementary Assistance" option was purchased prior to departure.

7. Technical and Navigation Rules

• Only engage reverse gear at low engine RPM.

• Constantly monitor the cooling water discharge (tell-tale) from the engine.

• Close the bimini top/sun awning in the presence of strong winds or at high speeds.

• Only operate the vessel along the routes indicated on the navigation map provided.

8. Privacy and Data Processing

A copy of the identity document is acquired by the Lessor for the purposes indicated in the Personal Data Processing Information (Arts. 13 and 14 of EU Reg. 2016/679). Rights arising from this agreement expire after one year.
